Please read this page carefully. When you book your holiday with us, you are entering into a contract, which binds you and us in various ways. Your holiday may be the most important purchase you make this year, so it is important that the obligations between us should be clear, concise and fair. If you are unsure about any of these terms and conditions then please contact us and we will happily answer your questions.
1. Terms and Prices. You may commence occupation of Chateau d'Hambye between 4.00 p.m. and 6.00 p.m., or such other time that is mutually agreeable (subject to any unavoidable delays). You must vacate Chateau d'Hambye by 10.00 a.m. on the day of departure. You are expected to leave your accommodation in a clean and tidy condition. Failure to comply with this vacation procedure may result in an extra charge being levied (see clause 8). All terms are per week for each self-catering holiday unless previously agreed otherwise. As soon as the booking is made by you and confirmed by us with the confirmation invoice, the hire terms are fully guaranteed and will not be subject to any surcharges. The prices quoted are in Sterling, and payment is required by Sterling cheque or bank transfer. No facilities exist to accept payment by credit card.
 
2. Making a Booking. You must complete and sign the booking form, accepting on behalf of your party the terms of these booking conditions, sending it to us with your deposit. The submission of the completed booking form shall constitute an offer by you and a contract shall come into existence when we issue a booking confirmation. For bookings within 8 weeks of the arrival date you must pay the full hire charge and all other costs at the time of booking. For booking from overseas (that is from outside the European Union), 50% of the hire charge is required as a deposit.
 
3. Payment of Balance. The amount payable will be shown on the confirmation invoice. It must be paid at least 8 weeks before the date of arrival. If you fail to pay on time, the owner reserves the right to treat your holiday as cancelled by you. In this case, we will retain your deposit and the provisions of Clause 5 will apply.
 
4. Insurance. You must state the name of your insurer on your booking form. Please read your policy details carefully as it is your responsibility to ensure that the insurance cover you purchase is adequate for your needs and covers your personal liability to at least 1 Million Euros.
 
5. Cancellation by You. Please telephone the owner immediately if you have to cancel, and on the same day send us written confirmation of cancellation of your booking by first class mail. Your cancellation is affective from the date we receive your written confirmation, which will be acknowledged. If you cancel 56 days or more before your arrival date, you will forfeit only your deposit. If you cancel less than 56 days before your arrival date, you will also be responsible for the balance, less any hire charges we may be able to recover through re-letting. You should ensure that you obtain adequate insurance cover for cancellation or curtailment.
 
6. Number of Persons. The maximum number of persons allowed in Chateau d'Hambye is as shown in this brochure/website, and all persons must be named on the booking form, including the ages of those under 18 years.
 
7. Included in the Price. Electricity, bottled gas and bed linen (towels not supplied).
 
8. Extra Costs. There will be an extra charge for any unforeseen local taxes that may be applicable. At the end of occupancy guests may prefer to clean the property themselves and leave it in the same state as it was found upon arrival, if not then a cleaning charge of €100 will be levied and in some cases where excessive cleaning is necessary this charge will rise accordingly.
 
9. Minors. Booking by persons aged under 18 years cannot be accepted.
 
10. All Male or All Female Bookings. All male or all female bookings will only be accepted at the proprietor's discretion.
 
11. Unsuitable Hirers. The Owner has the right to refuse to hand over Chateau d'Hambye to any person who, in her opinion, is not suitable to take charge. In addition, the owner has the right to repossess Chateau d'Hambye at any time if in her opinion, you or any member of your party is unsuitable to remain in charge because of their age, ill health, disability, suspected or actual influence of alcohol or drugs, or any other reason, or because of irresponsible behaviour likely to cause danger to themselves, other persons or property. In this situation the owner will have no further responsibility or liability and no refunds, costs or expenses will be made or met.
 
12. Availability. If the owner is prevented by circumstances beyond her control from making Chateau d'Hambye available and cannot provide a suitable alternative, she will refund monies already paid by you, but no further liability will be accepted.
 
13. Swimming Pool. Weather permitting, the pool will be filled between mid April and mid October and at other times will be unavailable.
 
14. Your Vehicles. The owner accepts no responsibility for any loss or damage from or to any vehicle from any cause whatsoever other than that caused by negligence.
 
15. Force Majeure. The owner regrets she cannot accept liability and no compensation will be payable where the performance or prompt performance of our contract with you is prevented or affected by "force majeure". In these Fair Trading Terms, "force majeure" means any event which could not, even with all due care, have been foreseen or avoided. Such circumstances may include war, civil strife, industrial action, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, technical problems with transport, closure or congestion of air, rail or sea ports, cancellation or changes of schedules by scheduled airlines and any similar events outside of our control.
 
16. Your Responsibility. You are responsible for the fully furnished Chateau d'Hambye and its equipment during the period of hire and are expected to take reasonable care of it. You are asked to notify the owner of any problems or defects immediately they become apparent, so as to enable the owner to rectify them and to maintain the high standards set by the owner. You undertake to report and pay for any damage caused to the holiday home or for equipment lost, damaged, broken or stolen during your occupancy. You may be asked to pay a liability deposit at the time of paying the balance of the rental. If no loss or damage has occurred, the liability deposit will be repaid to you after Chateau d'Hambye has been cleaned and checked.
 
17. Liability. The owner shall not be responsible to you or anyone at Chateau d'Hambye expressly or by implication with your authority for any accident happening, or injury suffered, or for any damage to, or loss to, any chattels sustained in the holiday home or the premises of Chateau d'Hambye.
 
18. Complaints Procedure. The owner wishes to know of any dissatisfaction. Complaints should be made in writing to the owner. It is not possible to refund any monies until your complaint is fully investigated.
